File an FTC report and ID Theft Police Report First
Your dispute letter must include these two items
- File your FTC Identity Theft Report at IdentityTheft.gov
- File a police report ( Some local Police Depts allow for online report filings for ID theft )
This matters because the FCRA identity theft block section (commonly referenced as 605B / 15 U.S.C. § 1681c-2) is built around sending a proper identity theft package — not a casual “not mine” dispute. You can read the statute here: 15 U.S.C. § 1681c-2.
Why most ID theft dispute letters don’t work.
Here’s the ugly pattern I’ve seen for years:
- Unscrupulous credit repair companies (and “template sellers”) often encourage people to falsely claim identity theft because it sounds like a cheat code.
- That creates a flood of weak or false “ID theft” claims. Real victims get mixed into the pile.
- With high volume, investigations can become assembly-line decisions, and legitimate cases can get prematurely labeled “verified” or “frivolous.”
However, if you follow the dispute protocol below and you’re a legitimate ID theft victim, you may be entitled to damages 💰

D.S.E.L Method for Accounts that belong to you
So this is the ID theft recovery process, which is laid out in the 4 steps below
- D — Discover: Pull all 3 credit reports and list every fraudulent account/item
- S — State it: File FTC report + police report (detailed, consistent)
- E — Execute: Dispute with bureaus (and often creditors) using mail + proof
- L — Litigate (if needed): If they refuse to do what the law requires, we escalate

Dispute by mail: CMRR + digital evidence (LetterStream)
Dispute by mail — not online
Mail gives you a record you can prove: what you sent, when you sent it, and what they received. Online disputes can be “processed” without creating the same clean evidence trail.
Use CMRR
CMRR = Certified Mail + Return Receipt Requested.
- Certified Mail provides a mailing receipt + tracking history.
- Return Receipt provides proof of delivery/signature details.
Why online certified mailing is better (my recommendation)
If you use an online certified mail service like LetterStream, you create a strong digital footprint:
- The exact documents you mailed are saved digitally
- The proof of mailing is saved digitally
- The tracking and (when selected) electronic delivery proof are saved digitally

What happens after you send your ID theft disputes
Under the identity theft block statute (15 U.S.C. § 1681c-2), credit reporting agencies generally must block identity theft information no later than 4 business days after receiving the required documentation, subject to exceptions/conditions in the statute. Read the law here: 15 U.S.C. § 1681c-2.

1) Should I dispute identity theft online?
I don’t recommend it for serious identity theft. Online portals are built for speed, not for building a clean evidentiary trail. Mail + CMRR is how you keep control.
2) What if I send the “perfect” packet and the bureaus keep reporting unrecognizable accounts that don’t belong to me ?
It happens. Even a flawless packet can be denied. If a legitimate claim is denied after the bureau/creditor received a proper package, that can create an FCRA issue depending on the facts. That’s when our associate attorneys can step in and pursue the matter on the client’s behalf.
3) What does “$0 out of pocket” mean at IMAX?

6) Should I include my full SSN in the letter?
I generally prefer last-4 unless a bureau specifically requires more. Your ID + proof of address + identity theft reports usually do the heavy lifting.
7) Should I dispute the identity theft account with the bank directly ?
Often yes, especially if the furnisher is still actively reporting. Many cases benefit from a coordinated approach: bureaus + creditors with consistent documentation.
8) What if this is a mixed file (someone else’s data merged with mine)?
Mixed-file situations often require heavier documentation and escalation. If you see wrong names, addresses, employers, or accounts that don’t match your life, get our help, You don’t need a police report or ID theft report for this.
9) What if the bureaus or banks says they need “more information” after my ID theft ?
If you’ve followed the protocol laid out in this article, then you’ve provided everything pursuant to the FCRA. If you’re missed Items mentioned in this article then re-send via CMRR.
