Why an unpaid Amex judgment will keep you from getting a mortgage or buying/selling a home?

Judgments typically show up on your public records even though they no longer appear on standard credit reports. Before approving a mortgage, refinance, or home sale, lenders run a public records search and will require any outstanding judgments to be paid or settled before closing. Can I dispute an American Express judgment or get it dismissed or deleted?

Realistically, it’s very difficult unless the you’re dealing with a fraudulent American Express account related to identity theft . Once a court enters a judgment, the case is decided.

In some situations, if American Express (or their law firm, often Zwicker & Associates) didn’t serve you properly, you may be able to petition the court to reopen the case. But reopening doesn’t dismiss anything — it just restarts the litigation process from scratch.

Unless you have solid evidence that the debt was past the statute of limitations when the lawsuit was filed, or that the charges were fraudulent, getting the judgment thrown out is unlikely.

What if I never got served by American Express and they got a default judgment?

You may be able to file a motion to vacate the default judgment on the grounds of improper service. But even if the court grants it, you’re back to square one — you now have an active lawsuit to defend. Unless you have strong grounds to fight the underlying debt (fraud, expired statute of limitations, etc.), you’ll likely end up in the same place. What percentage will American Express settle a judgment for?
