WHY YOU WERE SUED BY MIDLAND CREDIT MANAGEMENT (AND WHO THEY ARE)
Midland Credit Management and Midland Funding are part of a large debt-buying operation. In plain English:
- They don’t originate credit cards or personal loans.
- They buy old, charged-off accounts from banks and lenders for pennies on the dollar.
- Then they try to collect the full balance from you — often by filing a lawsuit.
Midland frequently uses collection law firms around the country (you’ll see the firm name on your Summons).
You can take one of three options,
- ⒈- Settle right away
- 2- Respond to their case and then settle
- 3- Fight the case .

IMPORTANT TIP: You must act within 20-30 days or you lose the case by default
When you’re served with a Midland lawsuit, you typically receive:
- 📄 A Summons – the official notice that you’re being sued.
- 📑 A Complaint – the document listing:
- How much Midland says you owe
- The original creditor
- Some basic facts about the account
Somewhere in those papers (or under your state’s rules) is a response deadline — usually around 20–30 days from the date you were served.
If you don’t respond in time:
- Midland can ask the court for a default judgment.
- With a judgment, they may be able to:
- 💸 Garnish part of your paycheck
- 🏦 Levy or freeze your bank accounts
- 🏠 Record liens against property
- 📈 Add interest and court costs, making the balance grow
Even if you’re not sure how you’ll pay yet, responding:
- Stops the automatic win
- Buys time to breathe and plan
- Gives you real leverage to negotiate or challenge the case

HOW TO RESPOND TO A MIDLAND LAWSUIT (STEP-BY-STEP)
Note: The steps below are general educational information, not legal advice. Court rules vary by state. For legal advice about your specific situation, speak with a consumer attorney licensed in your state.
1️⃣Find Your Exact Response Deadline
Carefully read the Summons and look for language like:
A written response to the court is usually due within 20-30 days from the time you got served.
It may say :
- “You have 20 days to file a written answer…”
- “You must respond within 30 days of service…”
Most people do not submit their answer to court, and therefore Midland wins the case by default.
2️⃣ Review the Complaint Line by Line
Go through the Complaint and identify:
- The original creditor (e.g., a bank or card issuer)
- The claimed balance
- Any partial account numbers
- Dates of default or last payment (if listed)
Ask yourself:
- Does this match an account I recognize?
- Does the amount look roughly correct or inflated?
- Could this be past the statute of limitations in my state?
- Could there be identity theft or mixed files involved?
Make notes of anything that seems off — those details matter later in negotiations and defenses.
3️⃣ Prepare and File Your Answer ( within 20-30 day deadline)
Your Answer is your formal written response to the Complaint. In many states, your Answer:
- Admits, denies, or states “lack of knowledge” about each numbered allegation
- Can raise affirmative defenses, such as:
- Statute of limitations (debt is too old to sue on)
- Lack of standing (Midland hasn’t proven they actually own your specific account)
- Incorrect amount, fees, or interest
- Payment, prior settlement, or dispute already in progress
- Identity theft or fraud
Filing an Answer does not mean you’re admitting the debt. It means you’re forcing Midland to actually prove their case instead of winning automatically.
4️⃣Serve Midland’s Law Firm
After you file your Answer with the court, you normally must send a copy to the law firm suing you on Midland’s behalf.
- The law firm’s name and address are printed on the Summons or Complaint.
- Follow your court’s approved methods of “service” (often by mail or another specific method).
Failing to properly serve the law firm can cause problems, even if you filed the Answer with the court.
5️⃣ Use the Extra Time to Negotiate or Build Your Case
Once your Answer is filed and served, the lawsuit usually slows down. You may have weeks or months before any court date. That time is valuable:
- 📂 Gather your own documents, statements, and records
- 📉 Assess what you can realistically afford in a lump-sum or structured settlement
- ⚖️ Consider speaking with a consumer attorney if your case is large or complex
- 🤝 Work with a credit advocate (like my team) to structure settlement or defense

MIDLAND CREDIT MANAGEMENT LAWSUIT FAQS
Can Midland Credit sue me for an old debt?
Yes, Midland can sue as long as the account is still within your state’s statute of limitations for debt collection lawsuits. If they sue after that time limit, the debt may be “time-barred,” which can be a powerful defense — but only if you raise it properly. The exact time limit depends on your state and the type of debt. For example in California, the statute of limitations is 4 years, which means that Midland can sue you for up to 4 years from the time the original debt fell behind ( not from when it was sold to Midland )
What happens if I ignore a Midland Credit lawsuit?
If you ignore the lawsuit and fail to respond by the deadline, Midland can ask the court for a default judgment. That judgment may give them access to tools like wage garnishment, bank levies, and liens. At that point, your leverage to negotiate drops significantly.
Will Midland Credit settle before court?
Often, yes. Once you file an Answer and show that you’re not an easy default, Midland may be open to lump-sum or structured settlements. The numbers depend on your case, your finances, and how strong their evidence is.
Should I just pay Midland Credit in full to make it go away?
Not automatically. Many people can:
- Settle for less than the full balance
- Structure payments that fit their cash flow
- Work toward better treatment of the account on their credit reports
Paying in full without a plan may mean overpaying and missing opportunities to improve your overall credit picture.
Our process saves you a significant amount compared to what Midland offers you to settle.
Will settling with Midland Credit hurt or help my credit?
Midland Funding removes collections once they’re settled. That will help your credit
